The accused killer of Etan Patz was formally informed of his murder and kidnapping indictment in Manhattan this morning, then quickly escorted back to jail pending a formal arraignment next month.
Lead prosecutor Armand Durastanti and defense lawyer Harvey Fishbein revealed in the brief hearing that the psychiatrically troubled Pedro Hernandez has been found fit to proceed by a panel of court-appointed lawyers.
Hernandez, who wore handcuffs and gray sweats, looked thin but calm, and peeked briefly over his shoulder to the audience before being led off. His wife, Rosemary, and daughter, Becky, gave him a brief smile in return.

Manhattan Criminal Court Judge Anthony Ferrara sent the case for arraignment to Manhattan Supreme Court Justice Maxwell Wiley, before whom Hernandez will plead not guilty on Dec. 12.
