A court-appointed psychologist dubbed a Manhattan dad an unfit parent because he refused to give in to his 5-year-old's demands to gorge on greasy grub at McDonald's, according to a new lawsuit by the frustrated father.

Attorney David Evan Schorr submitted to the forensic examination by E. 97th St. shrink Marilyn Schiller before a custody trial with his estranged wife Bari Yunis Schorr.

But David, 43, a former corporate attorney turned consultant with degrees from Oxford and New York universities, says the exam was a sham, based solely on a single contentious incident with his young son.

The Upper East Side dad had planned to treat his son to dinner at their "usual restaurant" on Oct. 30.

But "the child demanded to be taken to McDonald's instead and threw a tantrum when David (normally not a very strict father who rarely refuses his child McDonald's) demurred because his son had been eating too much junk food," according to the civil suit.

The dad then tried to offer his son a choice of any other healthy restaurant but the kid "dug in his heels for McDonald's."

David says in the suit that he wished "mightily that he had agreed to McDonald's in the first place" but "found himself in the unfortunate position of rewarding the child for bad behavior if he now agreed to…McDonald's."

So he gave his son an ultimatum: dinner anywhere other than McDonald's or no dinner.

"The child, stubborn as a mule, chose the 'no dinner' option."

Before dropping his son off at his mother's E. 84th Street building, David says he tried to make light of the situation by horsing around with him and trying one last time to change his mind about dinner.

But the son apparently tattled on his dad.

Then his mom, vice president of the members-only online shopping site Rue La La, called the psychiatrist to report the incident, according to the suit.

Bari sued her husband for a divorce in 2011, just four years after they married in a lavish ceremony at the St. Regis Hotel in Manhattan.

She recently filed motions asking the judge to punish David for flouting court orders and for a judgment on nonpayment of child support.

Her attorney, Louis I. Newman, declined to comment on the McDonald's matter.

"It's a litigation between Mr. Schorr and Mrs. Schiller," Newman said.

Dr. Schiller allegedly only interviewed the child and his mother then told the court David was "wholly incapable of taking care of his son" and should be denied his weekend visitation.

The disgruntled dad says in the past two and a half years that he has had partial custody of his son their time together "has run smoothly without incident" save a scarped knee.

David wants the shrink to return the $2,750 he paid for the evaluation.

Dr. Schiller told the Post she could not comment on the details of the incident. She only sad, "I am conducting a forensic evaluation on this matter. I will be issuing a confidential report to the court and the matter will be tried by the court."

The custody trial resumes in December.
