Cops have dropped a probe into a Mexican Consulate official and his wife whose 4-month-old baby died covered in bruises at an East Side hospital Tuesday, law enforcement sources said.
The parents of little Eduardo Rochea Ovalle — brought to NYU Langone hospital with a high fever, dehydrated and underweight — were released Wednesday after hours of grilling and will not be charged with any crime, the sources said.
During a police interview, the child's father, consular officer Eduaro Rocha Bracamontes, 36, told investigators that his wife, Gina Ximena, 26, is mentally ill, a source said.
Despite the battered condition of his body, officials believe the baby died of natural causes.
"They will not be charged with a crime," said a source.
Doctors worked for nearly 12 hours to treat and save the tot, who was brought in, unconscious, around 9:06 am.
An autopsy determined that little Eduardo had a left ear infection. There were lacerations to the back of his left earlobe, ulceration in the mouth through the back of his throat, and four fractured ribs. The cracked ribs were consistent with chest compressions, according to the city medical examiner's office.
A toxicology report is pending.
Bracamontes and his wife had previously been in touch with doctors about the baby's health, according to sources.
Police had been called to the couple's Murray Hill apartment twice in September and October to investigate verbal domestic incidents, but no arrests were made.
Sources said Bracamontes had tried to thwart an autopsy and wanted to take his son's body back to Mexico. According to super at the couple's apartment building, the family was planning to return to Mexico December 31.
