A federal appeals court on Thursday ruled that New York City has every right to keep churches out of its public schools.
The Second Circuit Court of Appeals reversed a 2012 lower court ruling by Manhattan Manhattan federal Chief Judge Loretta Preska that found city public schools couldn't block churches from hosting service events on school property.
"We conclude that the Board (of Education's) prohibition was consistent with its constitutional duties," the panel wrote in its 37-page opinion. "We therefore vacate the injunction imposed by the District Court and reverse its judgement."
The panel's ruling is the latest twist in a 14-year-old lawsuit in which an evangelical church, the Bronx Household of Faith, sued the city so it could continue hosting Sunday services at PS 15.
