The career criminal who fled the scene of a fatal crash that killed a young couple and their unborn baby has been indicted by a grand jury on the top count, prosecutors revealed today.

Julio Acevedo, 44, was indicted for leaving the scene of the accident, a D felony.

"There has been grand jury action and a true bill was voted," Brooklyn assistant district attorney Craig Esswein said in court.

Acevedo was brought to Brooklyn Supreme Court to meet with his attorney but didn't appear in the courtroom, defense attorney Kathleen Julian said.

"I'm not surprised. I fully expected him to be indicted," Julian said.

"There's no crime. They're judging him on his past," wife Dorothy Acevedo said after the brief proceeding.

Acevedo – who previously served time for killing the man who inspired rapper 50 Cent's stage name – swerved around a fire truck and was going about 60 mph when his BMW hit the livery cab carrying Nachman and Raizy Glauber, prosecutors have said.

Prosecutors also charged Acevedo with criminally negligent homicide, assault, and reckless driving and said he could face 25 years to life in prison.
