A grieving couple devastated when their four-month-old fetus died has sued Maimonides Medical Center for giving them the wrong remains – causing them to cremate and hold a service for the wrong body, Brooklyn court papers state.
Engaged couple William Werner and Abaline Nieves hit Maimonides with a $1 million suit.
"The baby was stillborn and they were given the wrong remains," said lawyer Raymond Voulo. "There's really no justifiable excuse for something like that happening."
Nieves went to Maimonides after her pregnancy developed severe complications in May 2013. Doctors induced labor which resulted in the fetus dying, the suit claims.
Nieves and her fiancée Werner had a Long Island funeral home pick up what they thought was the body of their unborn son, which they had named William Werner, Jr.
The mourning couple then held a service for the cremated ashes – but the next month they got a call from Maimonides asking for a meeting.
"Plaintiffs were advised that the remains previously released to them were not the remains of their son but that their son was still in the morgue at the hospital," the suit states.
"They had to go through the grieving process again," said Voulo, who represents the couple along with attorney Joseph Falbo.
